Terms of Service

These Terms govern access to and use of Clockify, operated by Benagon Technologies Private Limited (“Benagon”). By creating an account, starting a trial, or using the web console, kiosk, or mobile app, you agree to these Terms on behalf of yourself and, where applicable, the organization you represent (the “Customer”).

Clockify lets a Customer capture staff attendance via a shared kiosk device, an NFC card, or a printed QR code, and combine it with location and an on-device selfie check to produce an assurance score for each punch. Clockify is a record-keeping and verification tool; it does not itself constitute an employment relationship, payroll provider, or legal employer of any User.

New Customers receive a 15-day free trial with no card required. At the end of the trial, continued use requires an active paid subscription. You are responsible for keeping account credentials, kiosk codes, and NFC cards secure, and for all activity under your account.

You agree not to: falsify attendance records, share device or kiosk credentials outside your organization, attempt to bypass location or selfie verification, reverse-engineer or probe the service for vulnerabilities without authorization, or use the service in a way that violates applicable labour, data-protection, or other law.

The Customer is responsible for configuring the service in line with its obligations to its own staff (including notice of location and biometric-adjacent data capture where required by law), and for the accuracy of organization, site, and role data entered into the console.

Paid plans are billed in advance on the cycle selected at checkout. Fees are non-refundable except as described in our Refund Policy. We may change pricing on notice, effective at your next renewal.

Either party may terminate for convenience at the end of the current billing cycle. We may suspend or terminate access immediately for material breach of these Terms, non-payment, or activity that risks the security or integrity of the service.

The service is provided “as is.” To the maximum extent permitted by law, Benagon disclaims implied warranties and is not liable for indirect or consequential damages. Our aggregate liability for any claim is limited to the fees paid by the Customer in the 12 months preceding the claim.

These Terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of the courts at Idukki, Kerala.
